Item No. 3 <br /> PC: 9-17-92 <br /> UP-92-25 <br /> Page 1 <br /> RECOMMENDATION <br /> Staff recommends that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. UP-92-25 based on the Findings and subject to the <br /> Conditions of Approval recommended In the staff report. <br /> FINDINGS <br /> 1. The establishment, maintenance, and operation of the use does not conflict with the General Plan. <br /> This Finding can be made because the site's zone, AG-40, Is consistent with the <br /> General Plan designation, Agriculture, and the AG-40 zone permits churches with an <br /> approved Use Permit. <br /> 2. Adequate utilities, access roads, sanitation, drainage, and other necessary facilities have been <br /> provided, and the proposed improvements are properly related to existing and proposed streets <br /> and highways. <br /> This Finding can be made because the project is located on Lower Sacramento Road, <br /> which Is a public road. All utilities, Improvements, and the required facilities will be <br /> provided as reflected by the Site Plan and the required Improvement Plan. <br /> Conditions on the project will ensure the suitability of on-site services. <br /> 3. The property involved is of adequate size and shape to accommodate the proposed use and all <br /> yards, building coverage, setbacks, parking areas, and other requirements of this Title. <br /> • <br /> This Finding can be made because the 10-acre project site Is large enough to <br /> accommodate the proposed use. The proposed use complies with all Planning Title <br /> requirements regarding setbacks and parking as demonstrated by the site plan that <br /> was submitted. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> This Finding can be made because the Environmental Initial Study prepared for UP- <br /> 92-25 found that the project would not resuh In a significant, adverse Impact on the <br /> environment, and Public Works Is requiring all road Improvements to be Installed <br /> prior to use uniess a traffic study by the applicant shows that the road Improvements <br /> can be deferred without negatively affecting traffic on Lower Sacramento Road. <br />
