Analysis <br /> Background <br /> Use Permit Application No. UP-92-4 was approved for the Bear Creek Community Church by the Planning <br /> Commission on January 2, 1992. That project consisted of a 250-seat church in a 4,000-square-foot <br /> building on the project site for the requested five-phase, five-year church facility. A one-year Time <br /> Extension was approved by the Planning Commission on July 15, 1993. On August 18, 1994, the <br /> Commission approved a Revisions of Approved Actions application to increase the maximum seating <br /> capacity of the approved church facility from 250 to 500 seats. <br /> General Plan/Zoning Consistency <br /> The project site is designated on the maps of the General Plan as A/G (General Agriculture) with an <br /> accompanying, consistent zoning designation of AG-40 (General Agriculture; 40-acre minimum parcel <br /> size). According to Table 9-605.2 of the Development Title, Uses in the Agricultural Zones, all three <br /> 'Religious Assembly'use types(Neighborhood,Community,and Regional)are permitted in the agricultural <br /> zones subject to an approved Use Permit application. The decision to permit all Religious Assembly use <br /> types in the agricultural zones, rather than just Neighborhood as recommended by the Planning <br /> Commission, was made by the Board of Supervisors during the final public hearings before adoption of <br /> the General Plan 2010. There were no significant General Plan or zoning issues identified during the <br /> processing of this application. <br /> Area/Neighborhood Compatibility <br /> Because this is a five-phase project, the applicant has requested an approval period of five years, rather <br /> than the 18 months normally given to development projects. The recommended Conditions of Approval <br /> recommend that a five-year approval period be granted. <br /> There were no significant environmental or land use issues identified during the processing of the <br /> application, and there were no letters of opposition received from property owners in the vicinity of the <br /> project site as a result of the application referral for the Use Permit application. <br /> San Joaquin County UP-95-9/Bear Creek <br /> Community Development Page 6 <br />
