,WWI Now# <br /> "Failure to properly consider the traffic issues, present and prospective on Lower Sacramento Road, <br /> and the added impacts that will occur by authorizing the proposed use." <br /> RESPONSE TO APPEAL STATEMENT NO. 2 <br /> After reviewing the traffic study prepared by Dowling and Associates, the Department of Public Works <br /> determined that the project as conditioned would have a less than significant traffic impact. The Planning <br /> Commission's approval includes the following conditions from the Department of Public Works: <br /> 2_i. Traffic originating from the north shall access the site by traveling south along Davis Road,West <br /> Lane, or other roadway to Armstrong Road, then from Armstrong Road to north-bound Lower <br /> Sacramento Road. Access to the site from south-bound Lower Sacramento Road is prohibited. <br /> 2.j. Access shall be limited to right-turn in and right-turn out in conformance within the Lower <br /> Sacramento Road Special Purpose Pian. <br /> 2.k. Until the improvements to Lower Sacramento Road, as outlined in the Special Purpose Plan, are <br /> constructed, persons accessing the site shall not make U-turns along Lower Sacramento Road. <br /> APPEAL STATEMENT NO, 3 <br /> In the appeal, the appellant stated the following grounds for appeal: <br /> "Failure to exclude the school from the site in the AG zone based upon prior decisions by the <br /> County." <br /> RESPONSE TO APPEAL STATEMENT NO. 3 <br /> The project includes a K-4 school for approximately 50 students. A private school falls under the use type <br /> "Educational Services-General" which may be conditionally permitted in the agricultural zones with an <br /> approved Site Approval application (Development Title Section 9-605.2). The County has not made any <br /> prior decision to supersede or alter that regulation. Two projects processed in the last six years involved <br /> schools in the agricultural zones. The first was Use Permit No. UP-99-14 of Grewal Gurinder (c/o Pastor <br /> Tim Pollack) for a regional church and a K-12 private school in the AG-40 zone. The Board of Supervisors <br /> approved the church, but not the school. The second project was Use Permit No. PA-0200364 of Stockton <br /> Baptist Church to expand an existing school and church in the AU-20 zone.
