Silva Estates Subdivision <br /> Dear Mr. Seibel: <br /> Claudia Silva contacted me late on Thursday to let me know that the occupants of the dairy <br /> located at 26609 North Highway 99 Frontage Road in Acampo need to be off the premises before <br /> all the necessary work can continue on the subdivision. <br /> I have prepared a three-day notice for Jason and Lisa Rocha and have transmitted it to my <br /> process service to be served today. They are more than three months' delinquent on rent and we <br /> have been serving them three-day notices since the summer. They have yet to become current <br /> so I do not think they will be paid in full before the notice expires on Monday at 5 p.m. I will <br /> be mailing them a letter Monday outlining some of their options. If they do not become current, <br /> Claudia has instructed me to proceed with an unlawful detainer. If they do become current, I <br /> will be serving a 30-day notice to terminate the month-to-month tenancy. There is no written <br /> lease. <br /> After the complaint is filed, the parties are served. They then have five days from the time <br /> service is completed to file an answer. If no answer is filed, we apply to the court for a <br /> judgment and the sheriff then evicts. If an answer is filed, the matter is set for trial. Upon a <br /> favorable judgment, the sheriff evicts. If they choose not to leave voluntarily, the earliest they <br /> could be evicted would probably be December 29, depending on the sheriffs schedule. If we <br /> go to trial, then you would add about three weeks. If they did become current, and I really do <br /> not see that as a strong possibility, then the process could go into February because the 30 days <br /> would not expire until late January. Once they are evicted, there will not be another tenant for <br /> the dairy. <br /> If you have any questions please call me.
