%W10 *400, <br /> CONDITIONS OF APPROVAL <br /> MS-9428 <br /> Chase Due, et al <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been compiled with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. All parcels shall have a minimum width of 330 feet. (Development Title Section 9-610.4) <br /> b. All parcels shall be a minimum of 40 acres in size. (Development Title Section 9-610.2) <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> (See the attached memo from Public Works dated July 26, 1994.) <br /> 3. PUBLIC HEALTH SERVICES: <br /> (See the attached memo from Public Health dated July 25, 1994.) <br /> 4. COUNTY COUNSEL <br /> a. Pursuant to Section 66474.9 of the Government Code, the subdivider snail defend, <br /> indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> NOTE: On August 4, 1994, the San Joaquin County Community Development Department Approved MS- <br /> 94-28 subject to the Conditions of Approval fisted above. <br /> Conditions of Approval - 1 - MS-94-28 <br />
