CONDITIONS OF APPROVAL <br /> MS-91-38 <br /> PAGE TWO <br /> g. The Traffic Impact Mitigation Fee will be required for this <br /> subdivision. The fee is due and payable at the time of the <br /> building permit application. (The fee is $2 , 087 . 00 for each <br /> single family dwelling unit in the Ripon area. The fee shall <br /> be automatically adjusted annually by the Engineering <br /> Construction Cost Index as published by the Engineering News <br /> Record. ) <br /> 2 . PUBLIC HEALTH SERVICES <br /> ORDINANCE REQUIREMENTS: <br /> The Ordinance Requirements listed below have been identified as <br /> pertinent to this project. Other Ordinance Requirements may also <br /> apply. Ordinance Requirements are not appealable. <br /> a. A soil suitability study as required by Section 10100 of the <br /> San Joaquin County Development Code must be performed prior <br /> to application approval indicating that the area is suitable <br /> for septic tank usage. A permit for the percolation test is <br /> required from the Environmental Health Division, if the soil <br /> suitability study is favorable. <br /> b. Construction of an individual domestic water well under a well <br /> permit and inspection by the Environmental Health Division at <br /> the time of development on parcel #1 . <br /> c. The existing private water wells shall be tested for the <br /> chemical Dibromochloropropane (DBCP) and Nitrate prior to <br /> recordation of the Final Parcel Map. Samples are to be taken <br /> and run by a State-approved lab. <br /> d. Destroy the abandoned well under permit and inspection by the <br /> Environmental Health Division. <br /> 3 . COUNTY COUNSEL <br /> Conditions of Approval : <br /> a. Pursuant to Section 66474 . 9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, or its agents, officers, or employees to attack, set <br /> aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning <br /> a subdivision, which action is brought within the time <br /> provided for in Section 66499 . 37 of the Government Code. <br />
