(2) Pre-construction surveys for burrowing owls within 250 feet of the project boundaries shall be <br /> conducted prior to construction if construction is scheduled to occur between February 1 and <br /> August 31. In the event that active burrowing owl burrows are located, take avoidance <br /> measures shall be undertaken as described in CDFG's Staff Report on Burrowing Owl <br /> Mitigation(DCFG, 1994). <br /> (3) The attached Mitigation Monitoring Program for Quarry Excavation No. QX-00-01 is included <br /> as a Condition of Approval by this reference. <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Gabe Karam, 468-3000) <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer or Land Surveyor to include <br /> the following: <br /> (1) The first 100 feet from Madruga Road shall be paved. <br /> (2) A plan for the haul route using County roads shall be submitted to Public Works prior to the <br /> release of building permits. <br /> (3) No excavation or stockpiling of material shall be allowed within 25 feet of the property <br /> boundary or the County right-of-way. <br /> b. All private roads within the quarry shall be maintained to control dust. <br /> c. A video tape of the planned haul route showing conditions of all County roads shall be made. <br /> The condition of County maintained roads along the haul route shall be reviewed with Public <br /> Works prior to the start of excavation. (Development Title 9-1415.2) <br /> d. Loads on all public roads shall be restricted to legal loads only. (Street and Highway Title Section <br /> 10-2350) <br /> e. An encroachment permit shall be required for work within the Madruga Road right-of-way. <br /> (Development Title Section 9-1145.4) <br /> f. A cash deposit or security, adjusted every five years, in an amount and form acceptable to Public <br /> Works, shall be made to Public Works. The deposit shall guarantee that if the permittee fails, <br /> refuses, or neglects to repair roads along the haul route that may result from the permittee's <br /> operation, Public Works may do any work necessary to restore County roads along the haul route <br /> to equal or better than original condition, using the funds from said cash deposit or security. <br /> (Development Title Section 9-854.3) <br /> g. A Maintenance Agreement to ensure that County roads along haul routes are maintained to a <br /> condition acceptable to the County shall be executed by the applicant. The Maintenance <br /> Agreement shall be renewed every five years. <br /> h. A Traffic Impact Mitigation Fee will be required for this development. The Fee is due and payable <br /> at the time of excavation plan approval. The Fee currently is$170.83 per trip-end in the Manteca <br /> area. The Fee will automatically be adjusted July 1 of each year by the Engineering Construction <br /> Cost Index as published by the Engineering News Record. The number of trip-ends may be <br /> determined by a proportion to the length in time of quarry operation. <br /> i.
