SA-99-12 OF ALLEN POLINSKY <br /> -------------------------------------------------- <br /> The applicant has submitted the above referenced pre-application to establish an internet <br /> sales home occupation business. The General Plan designation is A/G and the zoning is AG- <br /> 40. The project site is located on the south side of Orchard Road, 1,300 feet east of Dustin <br /> Road, northwest of Lodi. <br /> Based on staff's review of the application and responses received from referral agencies, there <br /> are several issues that need to be addressed as follows: <br /> • Accessory building: County Development Title Section 9-839.5[b] states that "The home <br /> occupation may be conducted in a building on the subject property that is accessory to the <br /> residence provided said accessory building does not exceed four hundred (400) square <br /> feet of floor area.". The building in which the home occupation is to be operated was <br /> permitted by the County as an `agricultural storage' building which is not an accessory use <br /> to the residence. The subject building also exceeds the maximum permitted floor area. <br /> • Change of occupancy: Should it be determined that the project complies with <br /> Development Title Section 9-839.5, a change of building occupancy shall be required. This <br /> includes the construction of a one-hour fire wall/occupancy separation behveen the four <br /> hundred (400) square feet of office and the remainder of the building. No access shall be <br /> permitted between the office space and the remainder of the building. <br /> • Fees: Development Title Section 9-240.8[a] states "Whenever an application is made to <br /> correct a violation where a citation has been issued, or two (2) weeks notice has been <br /> given, the cost of the application shall be two (2) times the application fee normally <br /> charged for the application, up to a maximum five hundred dollars ($500) over the <br /> application fee normally charged.". There will be an additional five hundred dollar ($500) <br /> fee to the normal Site Approval Application fee for this project. <br />
