DECEIVED <br /> San Joaquin valley MAR - 8 2001 <br /> Air Pollution Control District Communq UeveloNfrnenr Uepr. <br /> Chandler Martin March 7, 2001 <br /> San Joaquin County <br /> Community Development Department <br /> Development Services Division <br /> 1810 East Hazelton Avenue <br /> Stockton, CA 95205 <br /> SUBJECT: UP-01-4 Construction of irrigation retention pond as part of an olive processing facility. <br /> Dear Mr. Martin: <br /> The San Joaquin Valley Air Pollution Control District (District) has reviewed the proposed project and <br /> offers the following comments: <br /> The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the Air <br /> Resources Board (ARB) for 03 (ozone) and PM-10(fine particulate matter, dust). The Federal Clean Air <br /> Act (CAA)and the California Clean Air Act require areas that are designated nonattainment to reduce <br /> emissions until standards are met. <br /> The construction phase of this project can generate emissions from the movement of soil, use of heavy <br /> equipment, bulk materials handling, asphalt paving and other related activities. As a result, this project is <br /> subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of Regulation VIII is to reduce <br /> the amount of fine particulate matter(PM-10) entrained into the ambient air from man-made sources. The <br /> attached Synopsis highlights many of the requirements contained within Regulation VIII. The Synopsis is <br /> not meant to be all-inclusive, but it can be a useful compliance aid in the field and office alike. <br /> Finally, the facility will be subject to District Rule 4102 (Nuisance). The purpose of this rule is to protect <br /> the health and safety of the public and applies to any source operation which emits or may emit air <br /> contaminants or other material. A possible violation could occur if the project proponent discharges <br /> quantities of air contaminant that result in the following nuisances: <br /> • Injury, detriment, or annoyance to any considerable number of persons or to the public. <br /> • Endangers the comfort, repose, health, or safety of any such person or the public. <br /> • Has a natura! tendency to cause injury or damage to business or property. <br /> Thank you for the opportunity to comment.
