Analysis <br /> Back-ground <br /> On August 5, 2008, the Community Development Department approved Minor Subdivision Application <br /> No. PA-0700593 to subdivide two lots totaling 425.64 acres into eight parcels and a designated <br /> remainder parcel, with each parcel containing a minimum of forty acres. The Parcel Map was recorded <br /> on December 30, 2008, On November 17, 2010, all of the parcels were sold to the present owner, <br /> Cortopassi Farms, Inc. On April 29, 2011, the new owner applied for this Reversion to Acreage <br /> application because Conditions of Approval 1.e. of the prior subdivision map application required a <br /> riparian habitat buffer that would limit his ability to farm the property. <br /> No improvements or dedications were required for the original subdivision. <br /> General Plan/Zonin <br /> The site is designated AIG (General Agriculture) and zoned AG-40 (General Agriculture-40 acre minimum). <br /> These designations will not change as a result of the reversion to acreage. <br /> Policy Consideration <br /> In order for the Board of Supervisors to approve the Reversion to Acreage application, it is mandatory <br /> that the first of the following four findings be made in the affirmative and that at least one of the remaining <br /> three findings be made in the affirmative pursuant to Development Title Section 9-869.4. <br /> Findinq No. 1 <br /> Dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are <br /> unnecessary for present or prospective public purposes, based upon the policies and designations in the <br /> General Plan. <br /> • This finding can be made because there were no dedications or offers of dedications <br /> required from the original Minor Subdivision application and therefore no vacated or <br /> abandoned dedications or offers of dedication are necessary by this reversion to acreage. <br /> Finding No. 2 <br /> Consent. All owners of an interest in the real property within the subdivision have consented to reversion. <br /> • This finding can be made because all of the owners of interest of the subdivision consent to <br /> the reversion and submitted the application for a Reversion To Acreage. <br /> Finding No. 3 <br /> Lack of Improvements: None of the improvements required to be made have been made within two (2) <br /> years from the date the final or parcel map was filed for record, or within the time allowed by agreement for <br /> completion of the improvements, whichever is later. <br /> • This finding can be made because no improvements were made as none were required for <br /> the subdivision. <br /> San Joaquin County PA-11000761Cortopassi <br /> Community Development Page 3 <br />
