PA-1200091 OF KEVIN WENTWORTH <br /> (APN: 089-040-23; ADDRESS: 8516 N. PEZZI ROAD, STOCKTON) <br /> This project is a Variance application to reduce the minimum parcel size in the AG-40 <br /> zone (General Agriculture, 40-acre minimum) from 40 acres to 0.81 acre and to reduce <br /> the minimum parcel width from 330 feet to 116 feet. The underlying project is a Minor <br /> Subdivision application to subdivide an existing 2.99-acre parcel into two parcels. Parcel <br /> One is to contain 2.18 acres with a width of 158.60 feet and Parcel Two is to contain <br /> 0.81 acres with a width of 116 feet. The parcels are not under a Williamson Act Contract. <br /> The project is located on the east side of Pezzi Road, 2,500 feet north of Comstock <br /> Road, east of Stockton. <br /> The Community Development Department has reviewed the application and offers the <br /> following comments: <br /> Background <br /> This project is a portion of Lot 13 of antiquated subdivision Stephens Tract. Stephens <br /> Tract created fourteen lots that were each ten acres in size. Lot 13 has been subdivided <br /> further by deed and also by parcel map. The subject property is a 2.99-acre portion of <br /> Lot 13. The surrounding use is primarily agricultural with scattered residences. The <br /> applicants purchased the property on April 18, 2012. <br /> Findings <br /> A Variance application provides a means of altering the requirements of the <br /> Development Title in specific instances where the strict application of those <br /> requirements would deprive a property of privileges enjoyed by other properties in the <br /> vicinity and under identical zoning because of special circumstances applicable to the <br /> property involved. The Community Development Department has reviewed the proposed <br /> Variance application and will be recommending denial based on the inability to make all <br /> of the required findings. <br /> 1 <br />
