BEFORE THE BOARD .,c" SUPERVISORS OF THE COUNTY .,F SAN JOAQUIN, STATE OF CALIFORNIA R-99-54 1 RESOLUTION GRANTING THE APPEAL OF DELORES STEVENS AND ELAINE CAMPIGLI OF VARIANCE APPLICATION NO. VR-98-3, BASED ON THE ABILITY OF MAKING THE REQUIRED USE PERMIT FINDINGS WHEREAS, on November 19, 1998, the San Joaquin County Planning Commission considered this matter; and WHEREAS, on January 26, 1999, this Board of Supervisors did conduct a public hearing on said matter, notice of which hearing was given in accordance with law, and oral and documentary evidence having been received in favor of or opposed to said matter, and this Board of Supervisors being advised on the premises; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby makes the required Use Permit findings as follows : 1 . That there are special circumstances applicable to the property relative to its proximity to the Mokelumne River and the natural state of the property which is not part of the farming operation. 2 . The granting of the Variance will not constitute the grant of special privileges because granting the Variance will provide a remedy for the 1963 Record of Survey which was not recorded. 3 . The granting of the Variance does not authorize a use or activity which is not otherwise expressly authorized by the regulation governing this parcel of property. NOW, THEREFORE, BE IT FURTHER RESOLVED by this Board of Supervisors that said appeal be and it hereby is, granted. PASSED AND ADOPTED this 26th day of January, 1999, by the following vote of the Board of Supervisors, to wit : AYES: SIMAS, GUTIERREZ, SIEGLOCK NOES : MARENCO, CABRAL ABSENT: NONE ROBERT I CABRAL ROBERT J.
