CONDITIONS OF APPROVAL <br /> MS-00-9 <br /> Stevens,et al <br /> Minor Subdivision Application No. MS-00-9 was approved by the San Joaquin County Community <br /> Development Department on July 17, 2000. The effective date of approval is July 27, 2000. This <br /> tentative map approval will expire on July 27, 2003, which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Jeff Fisher,468-9653) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 180-feet, measured at the front yard setback <br /> line. (VR-98-3;Board Order No. B-98-130; Resolution No. R-98-54) <br /> (2) All parcels shall have a minimum lot area of 5.15 acres (VR-98-3; Board Order No. B-98-130; <br /> Resolution No. R-98-54) <br /> b. RIPARIAN HABITAT ZONE: Within Parcel 1, parallel to the Calaveras River, a natural open space <br /> area for riparian habitat and waterway protection shall be maintained to provide nesting and foraging <br /> habitat and the protection of waterway quality. The minimum width of said open space shall be one- <br /> hundred (100) feet, measured from the mean high water level of the natural bank, or fifty (50) feet <br /> back from the existing riparian habitat, whichever is greater. Water-dependent uses may be <br /> permitted in this buffer. The mean high water level and the edge of the riparian habitat shall be <br /> shown on the Parcel Map. The open space buffer required above shall be shown on the parcel map <br /> with the following note: <br /> (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision,which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3.
