f <br /> VARIANCE FINDINGS <br /> PLYMOUTH OAKS 2, LLC <br /> (VR- ) <br /> 1. Because of the special circumstances applicable to the property, including size, <br /> shape, topography, location or surroundings, the strict application of the zoning <br /> regulations deprives the property of privileges enjoyed by other properties in the vicinity <br /> and under identical zoning classification. <br /> a. The property is burdened with a substantial hardship as a result of the existing <br /> and continuing economic climate and banking crisis which precludes financing <br /> for a condominium project. <br /> b. All of the required infrastructure and improvements are paid for and have been <br /> installed and completed. <br /> C. The existing thirteen (13) units that have been built cannot be sold due to the <br /> unavailability of financing for condominiums. The remaining ten (10) units will <br /> remain unbuilt without the requested variance to a single family residential map <br /> for all twenty-three (23) units. <br /> 2. The granting of the variance will not constitute a grant of special privileges inconsistent <br /> with the limitations upon other properties in the vicinity and zone in which the property is <br /> situated. <br /> The granting of the Variance will not confer a special privilege as all of the other <br /> properties in the area are already single family detached housing units and <br /> financed or otherwise built out. <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly <br /> authorized by the zone regulation governing the parcel property. <br /> This finding can be made because the Variance application is for adjustments to <br /> specific development title provisions and will not authorize a use or activity which <br /> is not otherwise authorized by the regulation governing the property. <br /> I <br /> 2 <br />
