i <br /> Commission approved Major Subdivision application PA-0600432 to merge the eleven (11) <br /> residential lots and resubdivide to create a single lot for twenty-three (23) condominium units. <br /> Each condominium unit consisted of a single family residence. Thirteen (13) of the twenty-three <br /> (23) condominium units have been built as of February 9, 2010. <br /> In order to approve the Variance, the Planning Commission is required to make three findings in <br /> i the affirmative. (Development Title Section 9-827.5) <br /> P <br /> I FINDINGS FOR VARIANCE <br /> Finding One: Special Circumstances <br /> Because of the special circumstances applicable to the property, including size, shape, <br /> topography, location, or surroundings, the strict application of the regulation deprives the <br /> property of privileges enjoyed by other property in the vicinity and under identical zoning <br /> classification. <br /> Applicant's Statement: <br /> a. "The property is burdened with a substantial hardship as a result of the existing and <br /> continuing economic climate and banking crisis which precludes financing for a <br /> condominium project.' <br /> b. "All of the required infrastructure and improvements are paid for and have been installed <br /> and completed." <br /> c. "The existing thirteen (13) units that have been built cannot be sold due to the <br /> unavailability of financing for condominiums. The remaining ten (90) units will remain <br /> unbuilt without the requested variance to a single family residential map for all twenty- <br /> three (23) units." <br /> This finding cannot be made because the documentation submitted by the applicant does not <br /> identify any special circumstances specific to this property relative to its size, shape, topography, <br /> location, or surrounding that would support the Variance. The parcel is relatively flat residential <br /> land of sufficient size and shape to enjoy the same privileges as other properties in the vicinity. <br /> This parcel does not have a unique shape. The unavailability of financing for condominiums is <br /> not a qualifying special circumstance. <br /> Finding Two: No Special Privileges <br /> The granting of the Variance will not constitute a grant of special privileges inconsistent <br /> with the limitations upon other properties in the vicinity and zone in which the property is <br /> situated. <br /> ` <br /> Applicant's Statement: <br /> "The granting of the Variance will not confer a special privilege as all of the other properties in <br /> the area are already single family detached housing units and financed or otherwise built out. <br /> This finding cannot be made because granting this Variance will constitute a grant of special <br /> privileges. The property is zoned R-M (Medium Density Residential). The minimum lot size is <br /> 2 <br />
