PA-0500055 OF PROTESTANT EPISCOPAL BISHOP OF SAN <br /> JOAQUIN COUNTY (C/O A CONTI ENGINEERING) to subdivide 2.91 acres into eleven residential <br /> lots of at least 6,000 square feet each. The project site is located on the east side of N. Plymouth Road, <br /> 120 feet north of W. Del Rio Drive, west Stockton (Supervisorial District 1). <br /> John Funderburg, Senior Planner, introduced the staff report into the record. <br /> PUBLIC HEARING OPENED: <br /> PROPONENTS: <br /> Paul Kozlow, an attorney representing the applicant, was present to answer any questions. He said there <br /> will be a lease agreement requiring tenants to abide by the rules. He said their goal is to maintain the <br /> property as rentals so that they eventually can be converted to condominiums when it is economically <br /> feasible. <br /> OPPONENTS: <br /> None were present. <br /> PUBLIC HEARING CLOSED: <br /> Commissioner Morn said he is concerned that the proposed 32-foot width for the driveway is not wide <br /> enough for emergency vehicles, especially if people park their RV's and boats on the street. <br /> Commissioner Blanchard asked if there will be a homeowners association. <br /> Paul Kozlow said there would not be one at the present time. These are just duplex units for rent. If they <br /> are converted to condominiums for sale, then there would be a homeowners association. <br /> Kerry Sullivan, Director, said that 32 feet is a standard width in many areas. This width does not conflict <br /> with any fire code regulations. <br /> Commissioner Eley said they could require CC&R's to limit the parking of RV's and other vehicles such as <br /> boats. <br /> Commissioner Morri said he agrees about the CC&R's. Truck trailers, two-ton trucks, boats, and RV's <br /> should be included. <br /> Commissioner Carter said CC&R's could help to limit the number of vehicles on the street. <br /> Paul Kozlow said the applicant will have rental agreements to handle that situation. These proposed <br /> CC&R's would not be compatible with future CC&R's once the development is turned into condominiums. <br /> The CC&R's for the condominiums would be much more strict. <br /> Commissioner Stockar said he sees no reason why CC&R's cannot be revised once the use changes from <br /> rentals to ownerships. <br /> Commissoner Eley said units could be sold to different owners, and then you would have problems because <br /> there would be no consistency. CC&R's should be applied. This project is surrounded by residential areas <br /> in the City of Stockton. Front lawn maintenance should also be required. <br /> Commissoner Morri suggested they continue this hearing to allow the applicant time to add CC&R's to the <br /> project. <br /> PC MINUTES - 5 - PC: 7-7-05 <br />
