CONDITIONS OF APPROVAL <br /> PA-0500297 <br /> Lagorio <br /> Minor Subdivision Application No. PA-0500297 was approved by the San Joaquin County <br /> Community Development Department on December 14, 2005. The effective date of approval is <br /> December 24, 2005. This tentative map approval will expire on December 23, 2008, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) <br /> c. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Certificate of Compliance legal description: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. <br /> d. RIPARIAN HABITAT: Parallel to the Calaveras River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The mean high water level and the edge of the riparian habitat shall be shown on <br /> the Site Plan. The open space buffer required above shall be shown on the Site Plans with the <br /> following note: <br /> (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection.
