Lease Agreement <br /> This agreement is made and entered into this 9th day of February 2005, between Gavino& Imelda <br /> Renteria, and Rogers Media Company of Davis, California, as Lessee. The parties hereby agree as follows. <br /> Gavino&Imelda Renteria, hereinafter Lessor, represent that they have the lease rights to property known <br /> as APN number, 197-020-05, with an address of 14840 South Highway 99, in Manteca, California. Lessor <br /> agrees to lease to Lessee, all general advertising signage rights to said property. More specifically, Lessor <br /> grants to Lessee the use of said property for the purpose of installing and maintaining a free standing <br /> advertising structure, to be used for general advertising purposes, for a period of ten(10)years, with an <br /> option to renew for three like periods. The option must be exercised by written notice at least ninety(90) <br /> days prior to the expiration of this lease. <br /> Said finished structures will be two 14'x 48'double faced signs, one pole sign structures, measuring no <br /> more than forty five feet to the highest point. This lease includes the ground and air space necessary to <br /> build, maintain, service and install said structures and subsequent advertising messages. The location of <br /> said sign on the property will be near the northern property line, approximately fifty(50)west of the <br /> eastern property line, and in the extreme southwest corner. It will not overhang any public right of way. <br /> Rent will commence upon the placement of said sign structure and continue monthly thereafter. Lessor <br /> agrees to file for permits within seven(7)days of the signing of this document and to commence <br /> construction not later than one-hundred and eighty(180)days after the signing of this document. <br /> In consideration thereof, Lessee agrees to pay Lessor per year, <br /> payable on a monthly basis at . If rent is not paid within 15 days of the due date(every <br /> 1st of the month for the month preceding), a late of 5%of the payment shall be'imposed. Lessee is to pay <br /> Lessor$100.00 for consideration until such time as construction begins and advertising is displayed. <br /> Lessor shall allow Lessee to install lighting fixtures for purposes of night lighting of the advertisement. All <br /> electrical *1l 41) ;tions and fixtures shall be in compliance with applicable building codes. Lessee shall at all <br /> times incurs all electrical expenses relative to said signs. <br /> Lessee shall at all times retain ownership of all structures,permits,and electrical fixtures placed upon <br /> Lessor's property and may remove same upon termination of this lease, regardless of the fact that said <br /> structures may constitute real estate fixtures. If Lessor fails to obtain proper City and Sate permits for the <br /> erection of said signs, such lease shall be come null and void. <br /> Lesser shall hold Lessor harmless from any loss, damage, or injury in the installation, maintenance or <br /> removal of said signs on the above mentioned properties. All insurance carried by Lessor shall be for no <br /> less than$2,000,000 of liability coverage.Lessor at any time during said lease agreement may view and or <br /> have copies of Lessee's gengral liability policy. <br /> If the view of the property or Lessee's sign is obstructed or impaired, or the use of such sign is diminished <br /> for any reason, or the use of such signs is prevented by law,Lessee has the option to terminate this lease <br /> upon thirty(30)days written notice to Lessor. Lessor agrees that neither they, nor any employee, agent,or <br /> representative of Lessor will install or permit any obstructions to the visibility of Lessee's signs. <br />
