c, - <br /> M E D I A C O M P A N Y <br /> Findings for 14840 South Highway 99 <br /> 1) Because of the special circumstances applicable to the property, including size, shape, <br /> topography, location or surroundings, the strict application of the zoning regulations <br /> deprives the property of privileges enjoyed by other properties in the vicinity and under <br /> identical zoning classification. <br /> Rogers Media Company after receiving a permit to do so,erected a 14' x 48' double faced off <br /> premise sign on the northern property line of 14840 South Highway 99 in 2005. The neighboring <br /> property to the north was a Valero gas station that maintained a small pole sign approximately 20 <br /> feet in height. <br /> On February 9, 2010,that neighboring gas station located at 14800 South Highway 99, now a <br /> Chevron began construction after receiving a permit and a variance to build a 260' square sign on <br /> premise sign,more than four times the size of the permitted use for this zone on the property just <br /> north of the Rogers Media project. This sign is 40' feet high and completely blocks the outdoor <br /> advertising sign rendering its use worthless. <br /> The Planning Commission in the past has given variances to other outdoor advertising firms when <br /> similar blockage has occurred. Specifically in the case of Silver Chase Storage, located in <br /> Southern San Joaquin County at 12565 West Klo Road near Lathrop,( Rogers Media's sign is <br /> located at US 99 and Lathrop Road,also in Southern San Joaquin County). A variance was <br /> granted to raise the sign in that instance to 65' feet overall when 50' was allowed by code. In our <br /> case we are requesting letting us raise the sign from 45' overall to 60 feet overall. We will also be <br /> reducing the size of the sign from 14' x 48' per face,to 14' x 40' per face. <br /> Please keep in mind the blockage that occurred in the Silver Chase Storage case was a not a <br /> neighboring property owner, but was in fact the same owner and property where the sign was <br /> located. We have a situation that after years of peaceful and legal enjoyment we have had our <br /> property rendered worthless by the act of a neighbor and the County by granting a sign size four <br /> times the legal code. <br /> We respectfully ask the Commission to consider that we would have never asked for a variance to <br /> raise our sign had the neighbor not acted to block it.
