On 11 February 2004 staff visited the
wastewater treatment system and observed wastewater pooled on the ground surface. Small berms had
been constructed in an attempt to crntaiu the wastewater. Discharge Prohibition No.A.3 states,
"Surfacing or spillage of wastewater at the treatment system or in the seepage pits areas is prohibited,"
Photographs of site conditions on 11 February 2004 are attached to this letter.
In addition,Axbor NHP failed to report the surface spill as required by the WDRs. WDRs Provision F_4
requires compliance with the Standard Provisions and Reporting Requirements, a copy of which is
enclosed. Standard Provision B.1 requires noncompliance be verbally reported to the Regional Board
immediately and a written_report submitted within two weeks. The failure of Arbor N[HP to report the
noncompliance is another violation of the WDRS.
A review of self-monitoring reports indicates all seepage pits are constantly in use indicating inadequate
disposal capacity exists_ In a telephone conversation oil 1.7 Febnlary 2004,you informed staff that 15 new
seepage pits have been constructed and are now in use, alleviating the capacity problem. Arbor WIP
should carefully manage the.wastewater system to prevent discharge of solids that can result in plugging
the new seepage pits.
By 1.9 Mauch 2004, Arbor IVfI:IP shall submit a report describing the spill(voluzre, duration, control
measures), an assessment of the cause of the spill, how the waste was cleaned up, and a report describing
how future spills will be prevented. Wastewater spills have been a recurring issue at Arbor MHP; further
spills, or the failure to rep ort such shills, may result in additional enforcement actions, which could
include imposition of Administrative Civil Liabilities.
California Environmental Protection Agency
a Reayckd Paper
The energy challenge facing California is real.
