Analysis <br /> Background <br /> The materials submitted to the Community Development Department by the applicant stated that the <br /> proposed use is for the storage, temporary storage, sale, rental, and repair of heavy equipment, farm <br /> machinery, and miscellaneous equipment and a welding shop. This application is the result of enforcement <br /> action against the operation and is an attempt to bring the operation into compliance. The uses proposed fit <br /> most closely into the scrap operation use type. <br /> Enforcement issues concerning this operation date back to July 11, 1996(Enforcement No. EN-96-79),when <br /> it was determined that the subject operation was not a permitted use in the General Commercial zone. In an <br /> attempt to bring the operation into compliance, at the direction of the Board of Supervisors(Board Order B- <br /> 98-262), the Community Development Department initiated and processed a General Plan Map Amendment <br /> and Zone Reclassification to change the General Plan and Zone from General Commercial (C/G, C-G) to <br /> General Industrial(I/G, I-G). General Plan Map Amendment No. GP-98-3 and Zone Reclassification No. ZR- <br /> 98-3 were approved by the Planning Commission on May 21, 1998, and by the Board of Supervisors on July <br /> 28, 1998. <br /> The use, which may be conditionally permitted in the I-G zone with an approved Use Permit, is now in <br /> operation. <br /> Issues <br /> This facility has been in operation for several years and in that time has accumulated a significant amount of <br /> recycled material that is stored at the site. Because open space is limited at the site, several issues have <br /> arisen concerning the Conditions of Approval: <br /> • Building Permits: The applicant has several structures used in the operation,including train cars, <br /> which have no building permits. Pursuant to the uniform Building Code, building permits shall either be <br /> obtained for these structures or the structures shall be demolished or removed. <br /> • Drainage: The applicant maintains that the parcel has existing approved drainage into an adjacent <br /> Caltrans basin. However,the applicant has provided no documentation to the Community Development <br /> Department supporting this. Until such documentation is received,the applicant must retain additional <br /> runoff on the site. This may require the removal of recycled materials stored at the site to provide space <br /> for the installation of a retention basin. Caltrans approval of the project is required. <br /> • Landscaping: The Development Title requires a 10-foot-wide landscape strip along adjacent rights-of- <br /> way. This includes both the frontage road on the east side of the property and State Route 99 on the <br /> west side. This ordinance will necessitate the removal and/or relocation of a significant amount of <br /> materials used in the scrap operation as well as one of the railroad cars. <br /> • Surfacing: Parking and major circulation areas shall be paved. Aggregate base is required for outside <br /> storage areas. The installation of this surfacing will necessitate the removal and/or relocation of the <br /> majority of the materials that are now sitting on bare ground. <br /> San Joaquin County UP-99-6\Nunes <br /> Community Development Page 3 <br />
