Analysis <br /> Background <br /> On December 2, 2004, the Planning Commission directed the Community Development Department to <br /> initiate revocation proceedings for Use Permit No. 295 and Use Permit No. 315 because of the excessive <br /> number of calls to the Sheriffs Department regarding disturbances at the project site. (Development Title <br /> Section 9-230.4[c)). On March 3, 2005, the Planning Commission modified the Use Permits to prohibit the <br /> sale of alcoholic beverages after 11:00 p.m., to prohibit dancing independent from the operation of the <br /> restaurant, and to prohibit live entertainment, except as permitted under Table 9-505.4 Temporary Uses and <br /> Structures in Industrial Zones for Special Events. <br /> Permitted Uses <br /> Restaurants are classified under the use type "Eating Establishments — Full Service" (Development Title <br /> Section 9-115.425(b)) which may be conditionally permitted in the I-L zone with an approved Site Approval <br /> application. Over the years, live music, special events, and dancing have been permitted and held on-site as <br /> accessory to the restaurant. In order to operate a dance club as a main use the use type would be "Liquor <br /> Sales-On Premises General" (Development Title Section 9-115.480(a)). The I-L (Limited Industrial) zone <br /> does not permit this use type. <br /> Sheriffs Department <br /> Lieutenant Moreno of the Sheriffs Department contacted the Community Development Department on <br /> September 28, 2006. The Sheriffs Department is recommending that the restrictions approved by the <br /> Planning Commission on March 3, 2005, remain intact and that the Revisions of Approved Actions <br /> application be denied. <br /> Neighborhood Opposition <br /> The Community Development Department has received a petition with 54 signatures (dated September 19, <br /> 2006) from the adjacent mobile home park requesting that no changes be made to the March 3, 2005, <br /> modifications placed on Use Permit 295 and 315. <br /> Proiect Proponent <br /> The Community Development Department has received one letter(dated October 9, 2006) in support of the <br /> Revisions of Approved Actions. <br /> San Joaquin County PA-050006\Yee <br /> Community Development Page 3 <br />
