Description of the proposed Revisions: On March 3, 2005 the Planning Commission modified Use Permits No.295&315. The three modifications were: (1)restaurant shall not serve alcohol after 11:00 p.m.; (2)dancing shall not be permitted independently from the operation of the restaurant;and(3)live entertainment shall be prohibited except as permitted under Table 9-505.4. Owner now proposes to remove these three conditions. 2. State the facts showing the changes in circumstances which make the subject condition(s)no longer appropriate or necessary. Since assuming ownership of the restaurant in early 2005,there has been a tremendous decline in Sheriff calls to this location,and many of those are by the owner to report crimes or illegal activities. The underlying reasons for the Use Permit modifications have been adequately addressed and are no longer the cause of concern to the Sheriffs Office or the neighbors.
