Analysis <br /> Background <br /> This Site Approval was filed on September 25, 1998. On November 18, 1998, the Community Development <br /> Department approved Site Approval No. SA-98-65,filed by Stott Outdoor Advertising. The approved project <br /> is a 14-foot by 48-foot,double-faced,off-premises,outdoor advertising sign located at the northwest corner of <br /> the State Route 99 and Hammer Lane interchange. <br /> On October 13, 1998, Obie Media filed a Site Approval application for a similar outdoor advertising sign on <br /> the southeast corner of the Highway 99 and Hammer Lane interchange. In accordance with the San Joaquin <br /> Development Title (Section 9-1710.6[a][4]), Obie Media's application was denied. This ordinance reads: <br /> "The space between off-premises signs shall be at least one thousand(1,000)feet on either side of the same <br /> street." Obie Media's site was situated within one thousand feet of Stott's site. Therefore, Obie Media's <br /> requestfora sign was denied. <br /> The Community Development Department processes applications as they are filed on a first come,first serve <br /> basis. Stott filed their application prior to Obie, hence, Stott's was processed first. On November 30, 1998, <br /> Michael Hakeem, representing Obie Media,appealed the Community Development Department's approval of <br /> SA-98-65. <br /> Obie Media's Appeal <br /> Appeal Statement No. 1. <br /> 1 The comment letter from the City of Stockton,dated October 16, 1998, confirms that the subject site <br /> is located within the area of a Project Study Report(PSR)sponsored by the San Joaquin Council of <br /> Governments to improve the traffic capacity of the State Route 99/Hammer Lane interchange. The <br /> City of Stockton's comment letter confirms that it is very likely there will be additional right-of-way <br /> requirementswithin the area of the proposed sign location to accommodatethe improvements. <br /> Response to Appeal Statement No. 1 <br /> Caltrans has three alternative designs for the State Route 99/Hammer Lane interchange. No preferred <br /> alternative has been identified, and there is no time frame for when the chosen plan will be implemented. <br /> Although it is likely that there will be additional right-of-way requirements needed within the vicinity of the <br /> proposed sign location, it is not likely that any of the three alternatives will require any movement or <br /> dismantling of the proposed sign. <br /> Appeal Statement No.2 <br /> 2. The proposed location will require a significant cutting of trees, which has not been properly <br /> disclosed and/or evaluated. <br /> Response to Appeal Statement No. 2 <br /> The proposed location may require the cutting or trimming of trees on the northeast side of the Sunshine Inn. <br /> These trees are not native oak trees, heritage oak trees, or historical trees, which have strict removal <br /> requirements specified in Section 9-1505 of the Development Title.
