this Agreement . (See exceptions noted in Exhibit D and <br /> Section 3 regarding Airport Noise Compatibility Program <br /> and Traffic Fees. ) <br /> Notwithstanding the foregoing, the reconstruction <br /> of any building which is substantially or wholly <br /> destroyed by an Act of God may be subject to those <br /> rules, regulations and official policies enacted sub- <br /> sequent to the Effective Date and prior to such Act of <br /> God, provided that such rules, regulations or official <br /> policies are directly related to life safety measures <br /> and preventing or mitigating the type of damage or <br /> destruction caused by the Act of God. <br /> (2) Application of Subsequently Enacted Rules, Regulations, <br /> etc. : The County may, hereafter, during the terms of <br /> this Agreement apply only such newer County enacted or <br /> modified rules, regulations, ordinances, laws, general <br /> or specific plans, and official policies which are not <br /> in conflict with those in effect on the date of this <br /> Agreement and application of which would not prevent <br /> development in accordance with the Plans that are pre- <br /> sently approved. However, this section shall not <br /> preclude the application to the subject property of <br /> changes in County laws, regulations, plans or policies <br /> specifically mandated and required by changes in state <br /> or federal laws or regulations. <br /> ( 3) Preservation of Public Health and Safety. The County <br /> may suspend the issuance of building permits for the <br /> - 10 - <br />
