State of California <br /> Memorandum <br /> ro State Clearinghouse Date February 24, 1978 <br /> 1400 Tenth Street <br /> Sacramento, California 95814 Place Sacramento <br /> From Department of Food and Agriculture <br /> Schedule No. 7802 0759 - ROBERTS ISLAND MARINA <br /> The preliminary EIR for the proposed ROBERTS ISLAND MARINA contains an <br /> inconsistency regarding the quantity of land which is proposed for redesignation <br /> under the Use Permit. While it appears that the entire 33 acre parcel is to be <br /> the subject matter of the Use Permit, only 7 acres may be needed, if the <br /> launching ramp is not constructed. To clarify the scope of the Use Permit, <br /> the EIR should either more precisely define the project limits or include <br /> project alternatives (e.g. one of 7 acres and one of 33 acres) which could <br /> be considered independently. <br /> If the project site is to encompass the entire 33 acres, the impact on adjacent <br /> agricultural lands must be discussed in greater detail. The EIR should note that <br /> the 33 acre parcel is adjacent to two parcels under Williamson Act contract <br /> (Nos. 71-13-28 and 71-34-30). As such lands are effectively enforceably restricted <br /> for a minimum ten year period to agricultural use, the EIR must delve into the <br /> possibility that project development may adversely impact (e.g. dust, noise <br /> complaints) agricultural operations and may create economic hardships on <br /> agricultural operators forced to limit or curtail such operations. <br /> Barry J.
