CONDITIONS OF APPROVAL <br /> PA-1500256(MS) <br /> ALECK E DAMBACHER III TR ETAL.(C/O O'DELL ENGINEERING) <br /> Minor Subdivision application no. PA-1500256 was approved by the San Joaquin County <br /> Community Development Department on August 31, 2016. The effective date of approval is <br /> September 10, 2016. This tentative map approval will expire on September 10, 2019,which is three <br /> (3) years from the date of approval, unless (1) all Conditions of Approval have been complied with <br /> and (2) a Certificate of Compliance has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Stephanie Stowers[209]468-9653) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated March 9, 2016. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a Notice of Minor Subdivision Restriction: <br /> All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> 1. Parcel 1 shall have a minimum lot width of 150 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> 2. Parcel 2 shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> 3. Parcel 1 shall be between two (2) gross acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> 1. The home site shall not be transferred until September 10, 2026, or upon the death of <br /> an owner owning at least fifty (50) percent interest in the home site parcel, unless the <br /> home site parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> 2. The property shown on the Parcel Map is restricted from further subdivisions for home <br /> site purposes, except for financing only, by Section 9-610.3 of the San Joaquin County <br /> Development Title. <br /> PA-1500256 (MS) Conditions of Approval 1 <br />
