CONDITIONS OF APPROVAL <br /> PA-0800112 <br /> Boersma <br /> Minor Subdivision Application No. PA-0800112 was approved by the San Joaquin County <br /> Community Development Department on August 1, 2008. The effective date of approval is August <br /> 11, 2008. This tentative map approval will expire on August 11, 2011, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Mo Hatef, (209)468-8477) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated May 2, 2008. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 330 feet and Parcel 2 shall have a minimum lot width <br /> of 150 feet. (Development Title Section 9-610.4) <br /> (2) Parcel 1 shall be between two (2) net acres and five (5) gross acres in size. (Development Title <br /> Section 9-610.3[a[) <br /> d. NOTICE OF NON-RENEWAL: A Notice of Non-renewal for all parcels below the ten (10) acre <br /> minimum parcel size will be required in conjunction with the contract. A fee for the recording of the <br /> Notice of Non-renewal is required. <br /> Note: A Notice of Non-renewal was applied for Williamson Act Contract number 730215 (APN#245- <br /> 160-12) and approved on October 4, 2006. <br /> e. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until July 10, 2018, or upon the death of an owner <br /> owning at least fifty (50) percent interest in the homesite parcel, unless the homesite <br /> parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> Conditions of Approval - 1 - PA-0800112 <br />
