San Joaquin County January 14, 2005 <br /> PA-0400776 Page 2 <br /> Additionally, District Rules 4901 and 4902 regulate the sale, installation and transfer of both <br /> wood burning devices and natural gas-fired water heaters to limit the emissions of PM10 and <br /> NOx in residential developments. Please note that on July 17, 2003 amendments to Rule 4901 <br /> where adopted by the District's Governing Board. Amendments to the rule may affect future <br /> construction plans for residential developments. Specifically: <br /> §5.3 Limitations on Wood Burning Fireplaces or Wood Burning Heaters in <br /> New Residential Developments: <br /> Beginning January 1, 2004, <br /> 5.3.1 No person shall install a wood burning fireplace in a new residential <br /> development with a density greater than two (2) dwelling units per acre. <br /> 5.3.2 No person shall install more than two (2) EPA Phase II Certified <br /> wood burning heaters per acre in any new residential development with a <br /> density equal to or greater than three (3) dwelling units per acre. <br /> 5.3.3 No person shall install more than one (1) wood burning fireplace or <br /> wood burning heater per dwelling unit in any new residential development <br /> with a density equal to or less than two (2) dwelling units per acre. <br /> As a result of the Valley's nonattainment status, the District strongly recommends that the <br /> project applicant and the County implement all feasible mitigation measures to reduce the <br /> amount of ozone precursors that will result from the build out of this project. Please note that <br /> some of these measures may already exist as County development standards. <br /> ♦ Energy efficient design including automated control system for heating/air conditioning and <br /> energy efficiency beyond Title 24 requirements, lighting controls and energy-efficient lighting <br /> in buildings, increased insulation beyond Title 24 requirements, and light colored roof <br /> materials to reflect heat. <br /> ♦ Planting of deciduous trees on the south and westerly facing sides of buildings. <br /> Provide low nitrogen oxide (NOx) emitting and/or high efficiency water heaters. <br /> ♦ If transit service is available to the project site, improvements should be made to encourage <br /> residents to use it. If transit service is not currently available, but is <br /> Planned for the future, appropriate easements should be reserved to provide for future <br /> improvements such as bus turnouts, loading areas, and shelters. <br />
