PA-0800004 (SA), NEW WINERY, LODI, SAN JOAQUIN <br /> COUNTY <br /> I have reviewed the Application Referral No. PA-0800004 (SA) for construction of a winery at <br /> 21400 N. Ray Road, Lodi that was distributed by San Joaquin County Community <br /> Development Department. The document briefly describes plans to construct a wine cellar <br /> and wine tasting room. <br /> Manufacturing wine generates wastewater that can produce nuisance odors and impact <br /> groundwater quality. California Water Code Section 13260(a) requires that any person <br /> discharging waste or proposing to discharge waste (i.e., winery wastewater and solids) must <br /> file a Report of Waste Discharge (RWD) and obtain either Waste Discharge Requirements <br /> (WDRs) or a wavier of WDRs from the Regional Board. Adoption of WDRs can take up to <br /> 150 days depending on the completeness of the RWD. Discharging wastewater without first <br /> securing a waiver or WDRs is a violation of California Water Code Section 13260 and exposes <br /> the discharger to enforcement actions, including fines. <br /> The proposed winery may qualify for a waiver of WDRs under Resolution No. R5-2003-0106, if <br /> either: (a) will crush less than 80 tons of grapes per year, (b) will produce less than 100,000 <br /> gallons of wastewater annually, or (c) will collect and haul all process wastewater for disposal <br /> off-site. Waiver Resolution R5-2003-106 can be found at the Regional Board website at <br /> http://www.swrcb.ca.gov/rwgcb5/adopted orders/Waivers/R5-2003-0106.pdf. Some large <br /> wineries have obtained coverage under the Waiver for the first few years of operation. Please <br /> note the existing waiver of WDRs will expire in July 2008. Staff expect a revised waiver will be <br /> presented to the Regional Board prior to the expiration. <br /> Storm Water Permit Information <br /> Depending on the Standard Industrial Classification (SIC) code of the final project, compliance <br /> with the National Pollutant Discharge Elimination System (NPDES) General Permit No. <br /> CAS000001 for Discharges of Storm Water Associated With Industrial Activities may be <br /> required. The SIC codes of activities requiring coverage are listed in the General Permit. In <br /> order to obtain coverage by the General Permit, the proponent must submit a Notice of Intent <br /> (NOI) to comply with the permit to the State Water Resources Control Board and a Storm <br /> Water Pollution Prevention Plan (SWPPP) must be prepared. <br /> California Environmental Protection Agency <br /> cd Recycled Paper <br />
