I -
STEVEN A. MALCOUN, INC.
ATTORNEY AT LAW
87 WEST MARCH LANE, SUITE 1
STOCKTON, CA 95207
(209) 476-0200
FACSIMILE. (209) 476-8980
STEVEN A. MALCOUN
September E; , 1991
Richard Larrouy . Associate Planner
San Joaquin Count f% Department of
Planning and Building Inspection
1510 East Hazelton Avenue
Stockton, CA 95245*
Dear Mr . Larrouv!
This letter will serve as our Notice of Appeal regarding
Minor Subdivision Application No . MS-92-7 . In particular ,
we are requesting a modification of conditions 2d , 2e and 2f .
Vie would request that these requirements become effective at
the -time of the development of the property instead of at the
recordation of the parcel map. In addition, Item 1c requires
the dedication and improvement of a .levee road. 14e assume
this to Rio Blanco Road. This condition seems inappropriate .
The levee is currently being reconstructed by Reclamation
District No . 2042 and I am not sure why theright-of-way
designation which is described is required. In addition, the
Subdivision Map Act provides for the deferment of
improvements of this type for parcel map unless specific
findings are made . Furthermore, it is unclear , given the
proposed parceli_ation, what conditions warrant the
improvement of this road. The requirement for improvement
would seem more appropriate with the future development of
this property and, as such, a deferred improvement. agreement
may be an appropriate method to ensure the future improvement
of this road.
Sincerely,
ST ,V MkL UN, INC .
n
STEVEN A.
