NOW .... <br /> ESS RESIDENTIAL DISCLOSURE REPORT <br /> TERMS, CONDITIONS, AND LIMITATION OF LIABILITY <br /> Environmental Safety Services (ESS)prepared this report(Report).The Report is for the exclusive use and reliance of the <br /> transactional parties,and their respective agents.The Report is intended for use as a residential disclosure document. It is <br /> not intended to be used for any other purpose,including,but not limited to,property appraisal or other valuation. ESS makes <br /> no representation as to the effect to valuation of the various disclosures in this report. <br /> This report is valid for this transaction and this property only.The Report applies only to the property address and <br /> assessor's parcel number (APN) furnished by the purchaser and shown on page one (1) of this report Purchaser is <br /> responsible for verifying the accuracy of the property address and APN within five(5)days of receipt ofthe Report. Upon <br /> notification of an inaccurate address or APN,ESS,at its sole option,will issue a replacement report or refund the price ofthe <br /> report in lien of replacement. ESS has no duty or obligation to inform the transactional parties,or their agents,of any <br /> changes or governmental actions pertaining to the Property occurring after the date of issue of Report. It is recommended <br /> that a request for update ofthe Report be made when Property remains on the market for an extended period oftime after the <br /> Report is issued. <br /> The liability of ESS,their agents,partners,employees and consultants,is limited to the transactional parties or their agents. <br /> ESS accepts no liability or duty to any third parry claiming an interest due to a relationship with either the transactional <br /> parties or their agents. <br /> ESS has relied solely upon the records and information specifically referred to in the Report for preparation of the Report. <br /> The records and information are supplied by various governmental agencies. ESS assumes that the records and information <br /> supplied by the various governmental agencies is complete and accurate. Consequently,ESS is not responsible for any <br /> inaccuracies or omissions in the public records or as reported by the various governmental agencies. No physical or visual <br /> inspection of the Property has been made(unless a Environmental Transaction Screen Report was requested with this <br /> y report). <br /> ESS does not assume responsibility or liability for any costs or consequences arising due to the need,or lack of need,for <br /> earthquake insurance or flood hazard insurance. The National Flood Insurance Program or an insurance agent should be <br /> contacted for information regarding flood insurance. An insurance agent should be contacted for earthquake insurance <br /> information. <br /> According to the Civil Code§ 1102.4,"The delivery of any information required to be disclosed by[Civil Code Section <br /> 1102]to a perspective[buyer]"by an outside expert..."Shall be deemed to comply with requirements of[Section 1102]and <br /> shall relieve the[seller and both agents] from any further duly..."In addition,"the delivery of a report—prepared by...[An <br /> expert]...shall be sufficient compliance"to give an exemption from liability for the seller and both agents for any error in the <br /> information provided,as long as the error or omission was not within the personal knowledge of the seller or agents. <br /> ACCEPTANCE, OR USE, OF THIS REPORT BY THE TRANSACTIONAL PARTIES AND THEIR <br /> RESPECTIVE AGENTS CONSTITUTES ACCEPTANCE OF THE CONDITIONS STATED.
