ESS RESIDENTIAL DISCLOSURE REPORT <br /> r <br /> Flood Hazard Area <br /> The Federal Emergency Management Agency(FEMA)designates areas of flood hazard for the National Rood Insurance Program on Flood <br /> Insurance Rate Maps.The maps do not necessarily show all areas subject to flooding in the community or all features outside special flood <br /> areas.This report identifies if a properly is within a special flood hazard area that begins with the letter"A"or"V" If property is within a <br /> special flood hazard area that begins with the letter"A"or"V",the property has been mapped as within a 100-year flood area,which is a <br /> ,. special flood hazard area. By law,federally regulated lenders must require flood insurance on loans for structures in special flood hazard <br /> areas. If property is located in an area that begins with any letter other than"A"or"V"shown on the Flood Insurance Rate Map,the <br /> properly Is not mapped in a special flood hazard area where flood insurance is required on bans. <br /> The designation of any area on maps of the National Flood Insurance Program may affect the cost and availability of insurance, <br /> requirements regarding flood insurance and financing,and building requirements including the ability to remodel or improve the properly. <br /> If the Property is in a special flood hazard area that begins with the letter"A"or"V",it is recommended that the appropriate city or county <br /> agency be contacted and requested to provide updates,if any,of the flood zoning undertaken by the city or county,updates,such as a Letter <br /> of Map Revision or Amendment are available from FEMA. ESS does not have general access to such updates unless famished by the <br /> Purchaser of this Report,and such updates generally are not reported or disclosed in this report. Site-specific information regxding special <br /> requirements related to flooding at a property may be obtained from the city or county building department that issues permits for new <br /> construction for the Property,from the financial institution that has issued or may be requested to issue a loan for the Property,or from a <br /> Registered Geologist or licensed Professional Engineer. If potential flooding of a Property is of concern for any reason, it is <br /> recommended that a licensed Professional Engineer be retained to conduct an investigation of the Property. <br /> Zone of Inundation from Dam or Reservoir Failure <br /> The California Department of Water Resources Dam Failure Inundation Maps indicates areas of inundation due to dam or Reservoir <br /> failure. Inundation from Reservoir,dam or dike failure in the aftermath of a seismic event can pose serious risks to large segments of the <br /> population. Reservoir failure maybe the result of direct ground rupture(if the Reservoir is located in or near a fault zone)or severe ground <br /> shaking.Flooding and possible dam failure could also occur in the event of an earthquake-induced landslide into the Reservoir,which <br /> displaces a large volume of water. <br /> Very High Fire Hazard Severity Zones <br /> Local fire authorities on Local responsibility Area(IRA)lands pursuant to Section 51179 of the Govemment Code through a ranking <br /> process based on fuels,topography,dwelling density,and weather identify Very High Fire Hazard Severity Zones,also known as Bates <br /> Zones. These zones are delineated on county-based maps,then digitally captured and merged to create a single statewide database. The <br /> owner of a properly within a Very High Fire Hazard Severity Zone is subject to the maintenance requirements of Section 51182 of the <br /> Government Code. The law adopted in 1992 requires in most cases a"class B"roof for new construction or replacement ofexisting roofs. <br /> Since 1997,the requirement has been upgraded to"class A"roof for all new construction or replacement of existing roofs,other fire <br /> defense improvements include minimum clearances of 30 feet around structures. <br /> State of California Fire Responsibility Areas <br /> The Califomia Department of Forestry and Fire Protection designates certain lands as State Fire Responsibility Areas(SRA's). The areas <br /> designated are lands where the State assumes primary financial responsibility for preventing and suppressing fires.These lands are covered <br /> wholly or in part by timber,brush,undergrowth or grass,whether of commercial value or not,which protect the soil from erosion,retard <br /> runoff of water or accelerated percolation,and lands used principally for range or forage purposes. Public Resources Code 4236 requires, <br /> "A seller of real property which is located within a state responsibility area determined by the board pursuant to Section 4125,shall disclose <br /> to any prospective purchaser the fact that the property is located within a wildland area which may contain substantial forest fire risks and <br /> .. hazards and is subject to the requirements of Section 4291." <br /> Page 2 of 4 NHDS Report Conditions February 25,2000 <br />
