PA-1000140 <br /> .REGARDING PARCEL MAP APPLICATION NO. PM-81-0090 OF NORBERT <br /> kOLLER (APN: 245-250-19; ADDRESS: 22205 E. RIVER DRIVE, ESCALON) <br /> This project is a Revisions of Approved Actions application to remove Condition of Approval No. 2 <br /> of previously approved Minor Subdivision PM-81-0090; which states, "Parcel B should be <br /> designated a nota;buildable site.' PM-90-0090 was to subdivide an existing 20-acre parcel into <br /> two parcels. Par�pl A contains one acre and Parcel B contains nineteen acres. Parcel B is under <br /> F Williamson Act contract. <br /> N, <br /> The project is Iodated on the north side of River Road, 640 feet west of Sexton Road, southwest <br /> of Escalon. The General Plan designation is General Agriculture (AG) and the zoning is General <br /> Agriculture, 40-acre minimum (AG-40). <br /> i <br /> The Community development Department has reviewed the application and offers the following <br /> comments: q; <br /> The original applicants applied for a subdivision application to divide a twenty-acre parcel into a <br /> ane-acre parcel and a nineteen-acre parcel. There was a residence on the proposed 1-acre <br /> parcel, but the o*ners did not live there. The application was denied by the Development <br /> Committee on January 21, 1981, because the project did not meet the requirements of Section <br /> 4104 of the Uniform Zoning Ordinance of San Joaquin County, which required the owner, or a <br /> family member Wf o made a substantial living from working on the farm, to live on the premises. <br /> On January 21, 4;981, the applicant appealed the decision to the Planning Commission. The <br /> Planning Commission heard the item on February 19, 1981, The Planning Commission voted to <br /> approve the subdivision with the condition that Parcel B (the 19-acre parcel) is not to be a <br /> residential building site. <br /> The current provisions of the Development Title for creating a homesite parcel are contained in <br /> Section 9-610.3(a,). Section 9-610.3(a) states: <br /> (a) Homesite Parcels. Homesite parcels may be approved in the AG zone, provided all of <br /> the following provisions are satisfied: <br /> (,1,) Not more than one (1) homesite parcel may be created from an existing <br /> parcel; however, under no circumstances shall the number of parcels resulting <br /> from the division exceed the maximum number of parcels permissible under the <br /> General Plan density. In determining how many homesite parcels have been <br /> created from an existing parcel, all homesite parcels created from an existing <br /> 1 - <br />
