In the <br /> truck it has a life of one hour." <br /> Commissioner Johnson, commented, "Has anyone from either side reached out to discuss the issues of <br /> noise and odor?" <br /> Attebery responded, "The applicant has reached out to the oppositions counsel, however, no one has <br /> visited any of the homes. Munn and Perkins is willing to reach out to the neighbors for any other on the <br /> ground solutions." <br /> Terpstra responded, "The applicant's counsel has visited my office and was interested in finding a solution <br /> to the noise and an EIR was prepared to analyze noise, however, no one has visited the homes." <br /> Commissioner Hamilton asked, "Are the sub haulers paid by the load or by the hour?' <br /> Attebery responded, "It can vary depending on the contract." <br /> PUBLIC HEARING CLOSED: <br /> Commissioner Villapudua said he agrees with the opponents on all regards specifically noise and odor. <br /> Commissioner Morn said he would not like to live in the area where the amount of trucks would increase at <br /> night and a truck passes by every two to three minutes. He favors the neighbor's position on this project. <br /> Commissioner Nickerson said, there is the potential to disturb thousands of commuters during the day if Cal <br /> Trans decides to pave roads during daylight hours. These are good reasons why Cal Trans paves roads at <br /> night. Also, two problems have been identified noise and odor. Both are a little bit less if you close the <br /> window and the number of people awakening at night is 97%-99%. Some people have hearing that might <br /> not be acute and there many variables to this conclusion and he has problems with the percentage of <br /> people who will be awakened. <br /> Commissioner Nickerson noted that staffs recommendation from denial to approval for this project changed <br /> and needed additional clarification. <br /> John Funderburg, said, there was additional information regarding the project history that was not available <br /> during the early preparation of the first staff report. After, staff reviewed the site project specifics, history and <br /> Development Title Staff was able to recommend approval for the project and prepare a Statement of <br /> Overriding Considerations for the proposed request. <br /> Mark Myles, also stated,the change in staffs recommendation from denial to approval was based on <br /> reviewing additional history for the project site including the te)d amendment in 1998 to allow for the <br /> continuation of accessory uses and the revisions of approved actions application in 1999 to e)dend the life of <br /> the quarry until March 4, 2029.Without this clarification along with the project benefits staff would have <br /> continued to recommend denial of the application and not consider a Statement of Overriding <br /> PC MINUTES 9 PC: 2-2-12 <br />
