Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Certify the project's Final Environmental Impact Report (EIR) No PA-0900114 as adequate under <br /> the provisions of Section 15090 of the California Environmental Quality Act (CEQA) (Attachment <br /> A); <br /> 2. Approve Revisions of Approved Actions Quarry Excavation Application No. QX-89-0002 with <br /> the Findings and Conditions of Approval in the staff report. <br /> 3. Adopt"Findings of Significant Environmental Impact"(Attachment B); <br /> 4. Adopt the "Statement of Overriding Consideration" (Attachment C); and <br /> 5. Adopt the "Mitigation Monitoring Program" (Attachment D). <br /> Prevoously Revised Findings <br /> 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not for the <br /> removal of prime farmland. <br /> • This Finding can be made because the proposed Revisions are not considered a conversion of <br /> prime farmland. Following excavation, the site will be returned to agricultural uses. The Revisions <br /> of Approved Actions is to permit extended hours of operation from 9:00 p.m. to 5:00 a.m.to <br /> accommodate paving construction project requirements for projects that contain specifications <br /> that limit work to nighttime hours.The number of extended nights of operation will not exceed 125 <br /> nights per Vear provided there are no unexpected delays. During the extended hours the work will <br /> be limited to the use of the asphalt batch plant, scale house,water trucks and loaders. <br /> 2. The proposed reclamation of the property upon completion of the excavation will leave the property in a <br /> condition which will allow its reuse. <br /> • This Finding can be made because the rehabilitation plan approved for this quarry excavation will <br /> return the site to agriculture. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements in the vicinity. <br /> • This Finding can be made because the Conditions of Approval and the EIR prepared for this <br /> project included mitigation measures that reduce impacts to the public health, safety,or welfare, <br /> or Injuries to the property or improvements of adjacent properties to less than significant levels, <br /> with the exceptions of haul truck traffic noise and odor from rubberized asphalt production. No <br /> other potentially detrimental health or safety impacts were identified that would be injurious to the <br /> properties and improvements in the vicinity. For those significant impacts, "Findings of <br /> Significant" (Attachment B) and "Statements of Overriding Consideration" (Attachment C) have <br /> been adopted. <br /> San Joaquin County QX-89-0002/Aggregates Inc. <br /> Community Development Page 9 <br />
