5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> • This Finding can be made because the Initial Study prepared for this project did not <br /> identify any known rare or endangered species or habitats or other substantial <br /> environmental adverse effects. However, prior to any ground disturbance, the Council of <br /> Governments is requiring that a pre-construction survey be completed by a Council of <br /> Governments biologist. <br /> 6 The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> • This Finding can be made because the Department of Public Works has provided a "will <br /> serve" letter stating sanitary sewer services through the Pacific Gardens Sanitary District <br /> and storm drainage services through the Riviera Cliffs Storm Drainage System can be <br /> provided for the proposed subdivision. In addition, the California Water Service Company <br /> has provided a "will-serve" letter stating water service can be provided to the proposed <br /> subdivision. <br /> 7. The design of the subdivision or the types of improvements will not conflict with easements acquired <br /> by the public at large for access through or use of property within the proposed subdivision. <br /> • This Finding can be made because there are no conflicts with the design of the proposed <br /> parcels. The applicant proposes a 15 foot Public Utility easement on the project side of <br /> the proposed paved 36 foot wide private road access easement, and the existing ten (10) <br /> foot wide Pacific Gas and Electric easement shall remain in place, all as shown on the <br /> Vesting Tentative Map. <br /> 8. Any land or improvements to be dedicated to the County or other public agency is consistent with the <br /> General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because there is no land to be dedicated to San Joaquin County <br /> for public roadways. Additionally, there are no applicable Specific Plans or Special <br /> Purpose Plans. <br /> 9. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or <br /> cooling opportunities in the subdivision, as required by Government Code Section 66473.1. <br /> • This Finding can be made because the lots are large enough so that individual dwellings <br /> can be situated to take advantage of solar energy. <br /> San Joaquin County PA-0800093\Hackett <br /> Community Development Page 6 <br />
