o. An Offer of Dedication of ground water rights on the Parcel Map is required. <br /> p. This development is subject to reapportionment under San Joaquin Area Flood Control Agency <br /> Assessment District No. 96-1 (Flood Protection Restoration Project). An application requesting the <br /> reapportionment of the unpaid portion of the assessment, along with payment of the reapportionment <br /> fee, shall be provided prior to approval of the Parcel Map. <br /> q. The developer shall prepare and record a notice to future owners of the duty to maintain the private <br /> road. The notice shall also appear on the face of the Parcel Map. (Civil Code 845[b]) <br /> r. Dischargers whose projects disturb one or more acres of soil or whose projects disturb less than one <br /> acre but are part of a larger plan of development that in total disturbs one or more acres are required <br /> to obtain coverage under the General Permit for Discharges of Storm Water Associated with <br /> Construction Activity (Construction General Permit 99-08-DWQ). Construction activity subject to this <br /> permit includes clearing, grading, and disturbances to the ground such as stockpiling or excavation <br /> but does not include regular maintenance activities performed to restore the original line, grade, or <br /> capacity of the facility. <br /> s. Construction sites shall result in soil disturbance of one acre or greater will require the preparation <br /> and implementation of a Storm Water Pollution Prevention Plan (SWPPP) meeting the requirements <br /> of the State Water Resources Control Board (SWRCB) Order No. 99-08-DWQ, Waste Discharge <br /> Requirements (WDR's)for Discharges of Storm Water Runoff Association with Construction Activity <br /> (General Permit). <br /> t. The proposed project is classified as a Priority Project in the County Phase I National Pollutant <br /> Discharge Elimination Permit and must comply with the County Water Quality Control Criteria Plan <br /> by filtering, treating, or infiltrating the 85"' percentile storm. County storm water fees are applicable. <br /> 3. ENVIRONMENTAL HEALTH DEPARTMENT (Staff Contact: Michael Escotto, 953-3443) <br /> a. This project shall be provided with public water service at the time of Final Map recordation. A letter <br /> shall be submitted from the purveyor stating that these services either are bonded for or are in place <br /> prior to final approval. (Development Title Section 9-1120.2) <br /> b. Written confirmation is required from Public Works that improvements have been constructed or <br /> financial arrangements have been made for any improvements for public sewer required by the <br /> agency. In addition, written confirmation from Public Works that the agency has or will have the <br /> sewer capacity to serve the development is also required. (Development Title Section 9-1100.3) <br /> 4. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> San Joaquin County PA-0800093\Hackett <br /> Community Development Page 9 <br />
