o. An Offer of Dedication of ground water rights on the Parcel Map is required. p. This development is subject to reapportionment under San Joaquin Area Flood Control Agency Assessment District No. 96-1 (Flood Protection Restoration Project). An application requesting the reapportionment of the unpaid portion of the assessment, along with payment of the reapportionment fee, shall be provided prior to approval of the Parcel Map. q. The developer shall prepare and record a notice to future owners of the duty to maintain the private road. The notice shall also appear on the face of the Parcel Map. (Civil Code 845[b]) r. Dischargers whose projects disturb one or more acres of soil or whose projects disturb less than one acre but are part of a larger plan of development that in total disturbs one or more acres are required to obtain coverage under the General Permit for Discharges of Storm Water Associated with Construction Activity (Construction General Permit 99-08-DWQ). Construction activity subject to this permit includes clearing, grading, and disturbances to the ground such as stockpiling or excavation but does not include regular maintenance activities performed to restore the original line, grade, or capacity of the facility. s. Construction sites shall result in soil disturbance of one acre or greater will require the preparation and implementation of a Storm Water Pollution Prevention Plan (SWPPP) meeting the requirements of the State Water Resources Control Board (SWRCB) Order No. 99-08-DWQ, Waste Discharge Requirements (WDR's)for Discharges of Storm Water Runoff Association with Construction Activity (General Permit). t. The proposed project is classified as a Priority Project in the County Phase I National Pollutant Discharge Elimination Permit and must comply with the County Water Quality Control Criteria Plan by filtering, treating, or infiltrating the 85"' percentile storm. County storm water fees are applicable. 3. ENVIRONMENTAL HEALTH DEPARTMENT (Staff Contact: Michael Escotto, 953-3443) a. This project shall be provided with public water service at the time of Final Map recordation. A letter shall be submitted from the purveyor stating that these services either are bonded for or are in place prior to final approval. (Development Title Section 9-1120.2) b. Written confirmation is required from Public Works that improvements have been constructed or financial arrangements have been made for any improvements for public sewer required by the agency. In addition, written confirmation from Public Works that the agency has or will have the sewer capacity to serve the development is also required. (Development Title Section 9-1100.3) 4. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code.
