Chair Carter said the area is very precious as far as agriculture
is concerned. It is an area that we need to save for agriculture.
Comm. Morri said his concern is over what Mr. Witt said about "some
time in the future" possibly building a home. We are not talking
about creating a parcel for a home now, but maybe 10 , 20, 30 or 40
years from now.
Director Chet Davisson commented that the zoning fits under the
1995 Plan and 1995 Planning Title, so if the homesite was not
approved and the zoning were approved, they could come back and
file a homesite parcel under the 2010 Plan with no requirement that
it be for financing a residence. This is an effort to streamline
application processing. The request could have been made under the
2010 Plan for a 40 acre parcel, and another application would be
required for the 10 acre parcel. The results would have been the
same, but the 1995 Plan required an "intent. "
Comm. Morri noted that under the 2010 Plan, a homesite parcel could
be obtained.
In answer to a question, Mr. McGrew said that the Williamson Act
does not allow the creation of a parcel smaller than 10 acres.
Comm. Morri said Mr. Witt is going to get a 10 acre homesite
parcel, regardless; therefore, he would make a motion to approve
the Minor Subdivision Application.
MOTION: Moved, seconded (Morri-Holly) to approve Minor Subdivision
Application No. MS-92-133 based on the Findings and Conditions of
Approval in the staff report.
Vote -
Ayes: Holly, Morri
Noes: Jungeblut, Rojas, Carter
Absent: Bozzano, Gillispie
(Under the provisions of Section 9-1062 (e) of the County Code all
decisions of the Planning Commission must be carried by an
affirmative vote of the majority of the Planning Commission;
therefore, the motion failed and the project is deemed denied. )
Comm. Jungeblut made a motion to reconsider so it can be continued
to October 22nd allow the two absentee Commissioners to listen to
the tape of this item and cast their votes.
This motion died 'for lack of a second.
-------------------------------------------------------------------
-3-
