Analysis - Environmental Impact Report <br /> Certification of the Final Environmental Impact Report <br /> Based upon information received from the applicant, it was determined that the proposed project could <br /> potentially have significant adverse impacts on the local environment. On the basis of that determination, <br /> an Environmental Impact Report (EIR) was prepared for the project by ESA, Inc. The EIR addressed the <br /> following issues: land use, agricultural resources, transportation, air quality and greenhouse gases, noise, <br /> aesthetics, biological resources, cultural resources, hazards and hazardous materials, hydrology, water <br /> quality, and utilities and service systems. The EIR identified the following significant, unavoidable, adverse <br /> impacts: 1) project-related noise exposure increases to residential uses in excess of the maximum 45 dB <br /> nighttime noise criterion and 2) degradation of the level of service due to increased traffic volumes on <br /> various locations on Airport Way, Roth Road, Lathrop Road and French Camp Road between Interstate-5 <br /> and State Route 99. Based upon this, a Statement of Overriding Consideration has been prepared and is <br /> included in this staff report as Attachment B. <br /> In accordance with the requirements of CEQA and the CEQA Guidelines, a Notice of Preparation <br /> ("NOP") of a Draft Environmental Impact Report ("Draft EIR" or "DEIR") was filed with the State <br /> Clearinghouse ("SCH") Office of Planning and Research ("OPR") on August 4, 2010 (SCH# <br /> 2010082016) and distributed for public and agency review. The NOP review period was issued on <br /> August 4, 2010 with a 30-day review period ending on September 7, 2010. A scoping meeting was <br /> held on August 25, 2010. Comments received on the NOP and a summary of scoping meeting <br /> comments were included in Appendix A of the Draft EIR. On September 21, 2011, the Community <br /> Development Department released for public review a Draft Environmental Impact Report. The required <br /> 45-day public review and comment period on the Draft EIR began on September 21, 2011 and closed <br /> on November 7, 2011. Hearings on the Draft EIR were held for the public and Planning Commission on <br /> October 25, 2011 and November 3, 2011, respectively. Comments received from the public and the <br /> Planning Commission on the Draft EIR are included in the Final EIR. All oral and written comments J <br /> received during the 45-day review period for the Draft EIR have been responded to and included in the <br /> Final EIR. Where necessary, the text of the draft document has been amended as a result of the public <br /> review process. <br /> Final EIR's were distributed on October 16, 2012, to the Planning Commission, responsible agencies, and <br /> all agencies and persons commenting on the Draft EIR. <br /> Determination of Adequacy of the Final EIR <br /> The only determination to be made by the Commission in order to certify the EIR is whether or not it is <br /> adequate as described in Section 15151 of the CEQA Guidelines. This section states in part"an EIR should <br /> be prepared with a sufficient degree of analysis to provide decision makers with information which enables <br /> them to make a decision which intelligently takes account of environmental consequences. An evaluation of <br /> the environmental effects of a proposed project need not be exhaustive, but the sufficiency of an EIR is to <br /> be reviewed in light of what is reasonably feasible." <br /> It is the Community Development Department's determination that the EIR meets the intent of this section. <br /> The document thoroughly discusses all potentially significant environmental issues, contains all sections <br /> required by law, and adheres to all review periods and time requirements.
