The statement of overriding considerations shall be supported by substantial evidence in <br /> the record. <br /> (c) If an agency makes a statement of overriding considerations, the statement should be included in the <br /> record of the project approval and should be mentioned in the Notice of Determination. This <br /> statement does not substitute for, and shall be in addition to, findings required pursuant to Section <br /> 15091. <br /> As required by CEQA, San Joaquin County, in adopting these findings, must also adopt a Mitigation <br /> Monitoring and Reporting Program ("MMRP') for the project. The MMRP, which is incorporated by <br /> reference and made a part of these findings, meets the requirements of Section 15097 of the CEQA <br /> Guidelines by providing for the implementation and monitoring of measures intended to mitigate potentially <br /> significant effects of the project. <br /> Whenever these findings specifically refer to and adopt a mitigation measure that will avoid or mitigate a <br /> potentially significant impact, that specific mitigation measure is hereby made a Condition of Approval of the <br /> Union Pacific Expansion and Modernization Project. <br /> 1.1 PROJECT SUMMARY <br /> The proposed project is the modernization and expansion of the existing Union Pacific (UP) Intermodal <br /> Facility (hereinafter referred to as the "UP modernization/expansion project", or "project's located at 1000 <br /> East Roth Road in the unincorporated portion of San Joaquin County and between the County of Lathrop <br /> and County of Manteca (see Figure 3-1). The existing facility, which has operated since 1993, covers an <br /> approximately 132-acre footprint on 238 acres of land owned or leased by Union Pacific. Union Pacific is in <br /> negotiations to acquire another 40 acres for a total of 278 acres, and the expanded facility would utilize the <br /> entire site. The Intermodal Facility would continue to undertake cargo container transfers in which cargo <br /> �,. containers are transferred to/from trucks to railcars. The existing capacity of 270,000 cargo container <br /> transfers ("lifts") per year would be increased to 730,000 lifts per year to meet projected regional needs. The <br /> facility lies in dose proximity to two major highways, Interstate (I)-5 and State Route (SR) 99, and the Union <br /> Pacific's Oakland and Fresno Subdivisions, which are connected to Union Pacific's national network, and <br /> within 100 miles of thirty California counties and more than 12.9 million people.The facility therefore serves <br /> as a transportation hub and railroad-to-truck transfer point for agricultural and other domestic freight. <br /> Intermodal cargo units are transferred from rail car to truck for local/regional distribution and from truck to <br /> rail car for long-haul shipment by rail as an alternative to long-haul truck shipment on regional highways.The <br /> applicant has requested a Use Permit from San Joaquin County (the "County") for the proposed expansion. <br /> This new permit would supplement two existing Use Permits governing operations at the site.
