Implementation of the project would result in the permanent conversion to non-agricultural use of <br /> approximately 154 acres of agricultural lands which have been are designated by the Department of <br /> Conservation FMMP as Prime Farmland and Farmland of Statewide Importance. This conversion of <br /> farmland would also contribute to cumulative farmland conversion in San Joaquin County; therefore, the <br /> project,when combined with other development within the County,would result in a cumulatively significant <br /> contribution to a significant cumulative impact to farmland. <br /> Findings <br /> The County finds that, pursuant to Section 15091(a)(1) of the CEQA Guidelines, changes or alterations <br /> have been required in or incorporated into the project, which would mitigate or avoid potential impacts to <br /> agricultural resources from the project as identified in the Final EIR The County further finds that the <br /> change or alteration in the project or the requirement to impose the mitigation as a condition of project <br /> approval is within the jurisdiction of the County to require,and that this mitigation is appropriate and feasible. <br /> Facts in Support of Findings <br /> Impacts to agricultural resources as a result of the project will be less than significant with implementation of <br /> Mitigation Measure LAND-1,which will require that the applicant dedicate,acquire or pay in lieu fees for the <br /> acquisition of a conservation easement to preserve farmland of equal quality and quantity as the farmland <br /> converted to non-agricultural use as a result of the project The project, with implementation of Mitigation <br /> Measure LAND-2 -- which in turns requires that the applicant implement Mitigation Measure LAND-1 to <br /> dedicate, acquire or pay in lieu fees for the acquisition of a conservation easement to preserve farmland of <br /> equal quality and quantity as the farmland converted to non-agricultural use -- would not result in a <br /> cumulatively considerable contribution to a significant cumulative impact to farmland. <br /> 4.1.2 Air Quality and Greenhouse Gases <br /> Summary of Potential Impacts <br /> An evaluation of potential impacts from au pollutant emissions and greenhouse gases during construction <br /> activities and long-term project operations is found in Section 4.3 (Air Quality and Greenhouse Gases) of the <br /> Draft EIR. <br /> Emissions during construction of the project,including grading, demolition, trenching, building and paving <br /> activities, could result in the exceedances of air quality thresholds, including for fugitive dust (PMio and <br /> PMzs) emissions. Air quality thresholds for volatile organic compounds ("VOC') and oxides of nitrogen <br /> ("NOx') emissions would be exceeded during project operations. Also, toxic au contaminants (diesel <br /> particulate matter ("DPM' ) thresholds related to health risks would be exceeded during project operations. <br /> Cumulative au quality impacts from criteria air pollutants and toxic air contaminants from the project would <br /> also exceed thresholds. <br /> Findings <br /> The County finds that, pursuant to Section 15091(a)(1) of the CEQA Guidelines, changes or alterations <br /> have been required in or incorporated into the project,which would mitigate or avoid potential impacts from <br /> criteria air pollutants and toxic air contaminants during construction activities and long-term project <br /> operations as identified in the Final EIR The County further finds that the change or alteration in the <br /> project or the requirement to impose the mitigation as a condition of project approval is within the <br /> jurisdiction of the County to require,and that this mitigation is appropriate and feasible. <br /> Findings of Fact/ 6 November 2012 <br /> Statement of Overriding Considerations <br />
