Surveys shall be conducted no more than 15 days prior to the potential <br /> disturbance. <br /> 3.if active nests(eggs/chicks present)are found during pre-construction <br /> surveys,the applicant shall establish a no-disturbance buffer(acceptable in <br /> size to the CDFG)around active raptor nests and nests of other special- <br /> status birds during the breeding season,or until it is determined that all <br /> young have fledged.Typical buffers are 300 to 500 feet for raptors and 100 <br /> to 250 feet for other nesting birds.The size of these buffer zones and the <br /> types of ground-disturbing activities restricted in these areas may be further <br /> modified during coordination with the CDFG and shall be based on existing I <br /> noise and human disturbance levels at the project area.Nests initiated <br /> during construction are presumed to be unaffected,and no buffer would be <br /> necessary.If pre-construction surveys indicate that nests are inactive or <br /> potential habitat is unoccupied during the construction period,nesting <br /> substrate(i.e.,trees,shrubs,and buildings)in this area can be removed, <br /> and no further mitigation is required. If active day or night roosts are found,the bat biologist shall take actions to <br /> make such roosts unsuitable habitat prior to tree removal. <br /> 3.A no-disturbance buffer shall be created around active bat roosts being <br /> used for maternity or hibernation purposes at a distance to be determined in <br /> 4 A qualified biologist holds an MOA with CDFG to handle bats. <br /> I <br />
