SAN JOAQUIN COUNTY HAZARDOUS MATERIALS INFORMATION GUIDE The following are guidelines to help building permit applicants and business license applicants determir whether they need to comply with the hazardous materials reporting requirements of Chapter 6.95 of tt California Health and Safety Code. Chapter 6.95 requires businesses which handle hazardous materials, at the California Threshold Plannir Quantities, to file a "Hazardous Materials Management Plan (HMMP)" with the Administering Agenc, In San Joaquin County, the Office of Emergency Services has been appointed to the Local Administering Agenc Businesses that handle Acutely Hazardous Materials will also be required to file an Acutely Hazardou Materials Registration Form and possibly complete a Risk Management and Prevention Progral ( RMPP)-. QVIDELINES: 1. Will the owner or future building applicant handle a hazardous material or a mixture containing hazardous material in a quantity equal to or greater than 55 gallons, 500 pounds, or 200 cubic feet z any one time? IF -YES-, THEN OWNER OR FUTURE OCCUPANT MUST MEET OR BE MEETING REQUIREMENTS OF CHAPTER 6.95, SECTION 2SSO5 OF THi HEALTH AND SAFETY CODE PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY. 2. Will the owner or future building occupant handle an Acutely Hazardous Material listed in the attache( Appendix? IF -YES', THEN THE OWNER OR FUTURE OCCUPANT MUST MEET OR BE MEETING THE REQUIREMENTS OF CHAPTER SAS, SECTIONS ZSSa: AND 25534 PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY. 3. Will the proposed building or modified facility be within 1,000 feet of the outer boundary of a schoo (grades K -12) and have Acutely Hazardous Materials? IF -YES' TO BOTH CONDITIONS, THEN THE OWNER MUST M= THE REQUIREMENTS OF CHAPTER 5.95, SECTIONS 25533 AND 25534 PRIOP TO ISSUANCE OF A BUILDING PERMIT. IF FUTURE OCCUPANT IS UNKNOWN AT THIS TIME: The fact that the building for which the permit Is being applied does not have a tenant at this time, does not relieve the owner or his authorized agent from the responsibility under California law. The owner or authorized agent must Indicate whether future occupants will need to comply with the reporting requirements for the handling of any hazardous materials. If at a later date the applicant determines that a tenant will be handling hazardous materials, the applicant must Inform the Office of Emergency Services.
