0
q
7 CITY OF RIVERBANK MAYOR
V , DAVID WHITE
f VICE MAYOR
CARL LEMMONS
6707 THIRD STREET • RIVERBANK. CALIFORNIA 95367 • AREA CODE 209 • 8693671 COUNCILMEN
PAULJOHNSON
CHARLES NEAL
BASIS FOR APPEAL SHERMAN PORTER
State the basis of the appeal (list any findings of fact made by the
review authority which were wrong and the reasons why they are wrong) . If
you wish to appeal a specific condition list it and the reasons the
condition should be changed or removed:
The City of Riverbank wishes to appeal the Environmental Impact Report
being required by the San Joaquin County Planning Department on our Use
Permit Application UP-89-30.
There are five (5) area that an E.I.R. should focus on according to the
Planning Department:
1 . Loss of riparian habitat and native vegetation;
2. Traffic;
3. Conflict with General Plan policies;
4. Access to Stanislaus River; and
5. Growth inducement.
The City of Riverbank believes that all five areas of concern can be
mitigated, and therefore, an E.I.R. would not be necessary.
1 . Loss of Riparian Habitat and Native Vegetation.
The City has agreed that the proposed golf course will not be within
fifty feet of the Stanislaus River. As with most rivers, the majority of
the thick vegetation in this area is within fifty feet of the river.
Valley Oaks are abundant in this area. Some of these trees wi eed to
be removed in order to clear some fairways. The City and t e golf course
architect will do their utmost to assure that as few trees as possible,
are removed. Trees are one of the greatest assets to a golf course and
the City will make every attempt to keep these assets.
Selected pruning of some of the Valley Oak trees on the project site will
allow more trees to remain. Selected pruning will also allow more
sunlight to enter in various areas which will enhance the growth of
grass, and provide for better air circulation. Irrigation will not be
within the drip line of the trees. The golf course architect (Robert
Muir Graves) is very familiar with Valley Oak trees. His firm recently
completed the design of the Cherry Island Golf Course in the Sacramento
area, which had numerous Valley Oak trees on site.
