Analysis <br /> Background <br /> On January 5, 2006, the Planning Commission approved Use Permit No. PA-0500725 on consent. There <br /> are no proposed changes to the project. The applicant needs more time to secure the proper financing for <br /> the project. <br /> The requested Time Extension does not alter any of the approved Conditions of Approval. Approval of the <br /> Time Extension is consistent with the requirements of the Development Title. <br /> Council of Governments <br /> A referral for the original project was mailed to the Council of Governments on November 18, 2005. They <br /> did not respond to the referral. A referral for the Time Extension was mailed on July 20, 2007. The Council <br /> of Governments responded in a memo dated August 3, 2007. <br /> San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and federal <br /> endangered species acts, and ensures that the impacts are mitigated below a level of significance in <br /> compliance with the California Environmental Quality Act (CEQA). Participation in the SJMSCP is voluntary. <br /> However, if the applicant chooses not to participate, then alternative mitigation in an amount and kind equal <br /> to that provided in the SJMSCP will be required. <br /> Letter of Opposition <br /> One letter of opposition regarding this project was received on July 30, 2007. The letter states that "in town <br /> would be a more appropriate site as there are many empty buildings. Also, all of the emergency agencies as <br /> well as parking are readily available." <br /> This project was approved on January 5, 2006. There was no opposition. There are no material changes to <br /> the project or the surroundings. No agency responses regarding safety were received.
