Analysis Background On January 5, 2006, the Planning Commission approved Use Permit No. PA-0500725 on consent. There are no proposed changes to the project. The applicant needs more time to secure the proper financing for the project. The requested Time Extension does not alter any of the approved Conditions of Approval. Approval of the Time Extension is consistent with the requirements of the Development Title. Council of Governments A referral for the original project was mailed to the Council of Governments on November 18, 2005. They did not respond to the referral. A referral for the Time Extension was mailed on July 20, 2007. The Council of Governments responded in a memo dated August 3, 2007. San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and Open Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and federal endangered species acts, and ensures that the impacts are mitigated below a level of significance in compliance with the California Environmental Quality Act (CEQA). Participation in the SJMSCP is voluntary. However, if the applicant chooses not to participate, then alternative mitigation in an amount and kind equal to that provided in the SJMSCP will be required. Letter of Opposition One letter of opposition regarding this project was received on July 30, 2007. The letter states that "in town would be a more appropriate site as there are many empty buildings. Also, all of the emergency agencies as well as parking are readily available." This project was approved on January 5, 2006. There was no opposition. There are no material changes to the project or the surroundings. No agency responses regarding safety were received. The required parking will be provided on site.
