`a.e Nno, Conditions of Approval MS-92-164 Page 3 4. SOUTH SAN JOAQUIN IRRIGATION DISTRICT: a. The owner shall execute the necessary documents and agreements to provide for the abandonment of service and the removal of irrigation structures for those parcels which will not continue to receive irrigation water. b. If irrigation and or drainage service is to continue, the appropriate private irrigation easements shall be provided. For private irrigation easements, place the following note on map near the location of the easement: "A size - foot wide private irrigation easement shall be conveyed across (lots) (parcels) (nos) at the time of conveyance. Pipeline to be installed at owner's expense. " The above note, together with the owner consenting to the preparation and filing of the map, gives constructive notice to title companies, future property buyers and the public of the requirement to provide a private irrigation easement as well as its size and location. C. The owner shall grant easements of sufficient width for all District facilities which may exist on subject property to serve as a replacement for any prescriptive and/or unrecorded easements= that are present. All existing recorded ,or- newly dedicated District easements shall be shown on the survey map prior to its recording. d. If the homesite area is lower than adjacent property, a permanent berm or ditch will need to be constructed around the homesite parcel to prevent accidental flooding from irrigation waters. Property owner shall either verify field elevations or submit a written statement to District indicating that property in question is not subject to flooding from adjacent irrigated property. e. A copy of the survey map shall be provided to the District Engineering Department for review to ensure that the above conditions have been satisfied.
