The project consists of a plan to <br /> construct a 210-person church facility on approximately three acres. The project is <br /> located on the west side of Seventh Street in Banta. San Joaquin County. <br /> Wildlife habitat resources consist of a small rural community (Banta) surrounded <br /> by agricultural fields. The project site is adjacent to an alfalfa field. Significant <br /> resources of the project include a row of locust trees along the southern border of the <br /> project site. The locust trees contain an active Swainson's hawk (Buteo swainsoni) <br /> nest. <br /> We are concerned that the proposed project has the potential for impacts to the <br /> State-listed threatened Swainson's hawk. We recommend that the Site Approval <br /> Application be conditioned so that: <br /> 1 . Destruction of the row of locust trees is avoided. The applicant should be <br /> required to leave the row of locust trees in place so that there is no los of <br /> nesting habitat for the Swainson's hawk. <br /> 2. In order to avoid disturbance impacts to nesting Swainson's hawks, the <br /> project's construction activities should be constrained by DFG's Staff <br /> Report regarding Mitigation for Impacts to Swainson's Hawks in the <br /> Central Valley of California. 1994 (enclosed). <br /> Pursuant to Public Resources Code Sections 21092 and 21092.2, the DFG <br /> requests written notification of proposed actions and pending decisions regarding this <br /> project. Written notifications should be directed to this office. <br />
