CONDITIONS OF APPROVAL <br /> MS-95-31 <br /> Carone <br /> On July 14, 1995,the San Joaquin County Community Development Department approved MS-95-31 <br /> subject to the Conditions of Approval listed below. This approval will expire 36 months from the date <br /> of approval unless (1) all Conditions of Approval have been compiled with and (2) a Parcel Map has <br /> been submitted to the County Surveyor for approval. <br /> Those Conditions followed by a Section Number have been Identified as ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Richard Larrouy, 468-3142) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this <br /> map: <br /> (1) This approval is for a Minor Subdivision application to create a homesite parcel <br /> for financing purposes only and a designated remainder as shown on the <br /> Tentative Parcel Map submitted May 15, 1995. <br /> (2) Parcel A, the financing homesite parcel, shall have a minimum lot width of 150 <br /> feet, measured at the front yard setback line. (Development Title Section 9-610.4) <br /> (3) Parcel A shall contain not less than two acres nor more than five gross acres. <br /> (Development Title Section 9-610.3{b}{4}) <br /> b. MAP AND NOTICE REQUIREMENTS: The following map and notice regulations shall <br /> apply to this map: <br /> (1) The homesite and remainder parcels shall have a Notice of Minor Subdivision <br /> Restriction recorded by separate instrument concurrently with the map to indicate <br /> the following restrictions: <br /> (A) Neither the homesite parcel (Parcel A) nor the designated remainder <br /> parcel may be voluntarily transferred separately from the other parcel; <br /> however, if an institutional lender forecloses on either parcel, either parcel <br /> may be transferred separately in accordance with the power of sale <br /> provisions contained in the deed of trust. <br /> (B) Upon repayment of the loan, the owner of the homesite parcel shall <br /> merge the homesite parcel with the designated remainder parcel, as <br /> provided for in the Development Title, unless the owner of the homesite <br /> parcel acquired the homesite parcel through a foreclosure action, or <br /> unless the owner refinances the loan. <br /> (C) The designated remainder parcel shall remain a nonbuildable site for <br /> primary dwelling units. <br /> Conditions of Approval - 1 - MS-95-31 <br />
