CONDITIONS OF APPROVAL <br /> PA-1500198(MS) <br /> GIANNECCHINI,TR.IDILLON& MURPHY <br /> Minor Subdivision application no. PA-1500198 was approved by the San Joaquin County <br /> Community Development Department on April 25, 2016. The effective date of approval is May 5, <br /> 2016. This tentative map approval will expire on May 5, 2019,which is three (3)years from the date <br /> of approval, unless (1) all Conditions of Approval have been complied with and (2) a Certificate of <br /> Compliance has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Stephanie Stowers[209]468-9653) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved revised tentative map dated April 18, 2016. A fee is required to process <br /> the Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b),the following note shall <br /> be recorded as a separate instrument with the Certificate of Compliance: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this Certificate of <br /> Compliance: <br /> 1. Parcels 1, 2, 3, 4, 5, 6, 7, 8, 9, & 15 shall have a minimum lot area of 80 acres. (Development <br /> Title Section 910.2) <br /> 2. Parcels 10, 11, 12, 13, & 14 shall have a minimum lot area of 40 acres. (Development Title <br /> Section 9-610.2) <br /> d. NOISE: If noise sensitive development is proposed within 96 feet from the edge of the State Route <br /> 26 along the northern portion of Parcel 1, Parcel 2, and Parcel 3; along the western portion of Parcel <br /> 4, Parcel 6; or the eastern portion of Parcel 15, then a noise study shall be required prior to noise <br /> sensitive development and construction must comply with recommended mitigation measures to <br /> achieve compliance with the standards specified in Table 9-1025.9. (General Plan Table IIID-4B, <br /> Volume III, page III.D-25) (Development Title Section 9-1025.9(a)[11) (Development Title Section 9- <br /> 1025.9(d)[4]) <br /> e. RIPARIAN HABITAT: Parallel to the Calaveras River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer.
